These Terms govern your use of regencymedicalpharmacy.com and of our online, text and delivery services. “We,” “us” and “Regency” mean Carpharma, doing business as Regency Medical Pharmacy. We are a pharmacy licensed by the California State Board of Pharmacy (license no. 59513) at 1000 Newbury Rd, Suite 100, Newbury Park, CA 91320. By using our website or services, you agree to these Terms. If you don’t agree, please don’t use them.
1. Not medical advice
Our website gives general information. It is not a substitute for advice about your own care from your doctor or pharmacist. If you think you are having a medical emergency, call 911. For a possible poisoning or overdose, call Poison Control at 1-800-222-1222.
2. Prescriptions and pharmacist judgment
- We fill prescription medications only on a valid prescription from a licensed prescriber, as federal and California law require.
- Our pharmacists use professional judgment. They may delay or decline a fill when the law requires it or when a safety concern must be resolved first. If that happens, we will tell you and help with next steps, such as contacting your prescriber.
- Unless your prescriber says “Do not substitute,” our pharmacist may give you a generic in place of a brand-name drug when the law allows and it costs you less. We will tell you, and your label will name the drug you received.
- A pharmacist can answer questions about your medications at (805) 375-4050, Monday through Friday, 9:00 AM to 5:30 PM, and Saturday, 10:00 AM to 1:00 PM.
3. Compounded medications
We prepare compounded medications for an individual patient when a prescriber orders them. As the FDA explains, “Compounded drugs are not FDA-approved. This means that FDA does not verify the safety, effectiveness or quality of compounded drugs before they are marketed” (FDA). We do not claim that a compounded medication is the same as, or a replacement for, an FDA-approved drug. Follow the storage directions and the beyond-use date on your label.
4. Ordering
You can order by text or phone, through our Auto-Refill & Rx Transfer page, or by asking your prescriber to send your prescription to us. Please give us accurate, current information, including your address, insurance, allergies and other medications.
5. Delivery and shipping
- We offer free next-day delivery anywhere in California.
- We offer free ground shipping to Arizona, Colorado, Florida, Hawaii, New York, Utah, Washington and Washington, D.C. Shipping usually takes 1–3 business days, and Hawaii can take longer.
- Delivery dates are our goal, not a guarantee. Weather, carrier delays, insurance approvals or a question for your prescriber can delay an order. If we can’t deliver or ship when we said, we will tell you, and you can accept the delay or cancel for a prompt refund.
- Some medications need special handling or can’t be shipped to every location. We will tell you if that applies to your order.
- Some deliveries may require a signature.
- Don’t take a medication if the package arrives damaged or looks tampered with, or if the medication may have been exposed to temperatures outside its label directions. Call us at (805) 375-4050 and we will help.
6. Auto-refill program
When you enroll, we show you the program terms, and you sign up for each medication. Typing your name to sign is your electronic signature. In short:
- We refill each medication you enroll when it is due, as long as your prescription has refills left and the law and your plan allow the refill.
- A pharmacist reviews every refill before it goes out.
- Each time we refill a medication through the program, we send you a written or electronic notice, such as a text message.
- Each enrollment lasts 12 months. We will ask you to renew before it ends.
- If your prescriber changes the medication, strength, dosage form or directions, we won’t auto-refill the new prescription until you enroll it in writing or online.
- If you keep a card on file with us, we charge it only up to the limit you set. If a refill would cost more, we check with you first.
- You can stop at any time, for one medication or the whole program. Text or call (805) 375-4050, email [email protected], or choose “Stop or change” on our Auto-Refill page. We will confirm when it’s done.
- If you tell us you didn’t want a refill, for any reason, or you had already stopped auto-refill before it was dispensed, we will give a full refund to you or your insurance.
- Need the program notices in another language? Call (805) 375-4050.
If the program terms you accept at sign-up differ from this summary, the program terms control.
7. Prescription transfers
When you ask us to transfer a prescription, you authorize us to contact your current pharmacy and, if needed, your prescriber. Some prescriptions can’t be transferred, such as those with no refills left or those the law limits. If so, we will contact your prescriber or let you know.
8. Prices, insurance and payment
- If you give us your insurance information, we bill your plan. Your plan sets your copay or coinsurance.
- If a medication isn’t covered or needs prior authorization, we will tell you and explain your options, such as working with your prescriber or paying the cash price.
- With your permission, we look for manufacturer coupons and savings programs you qualify for. Each program sets its own rules, and some exclude people with government insurance.
- We do not collect card numbers by text or on this website. To keep a card on file, we will call you, or we can text you a secure payment link. We may hold an order until payment is complete.
9. Returns and refunds
For your safety, we cannot accept returns of prescription medications once they have left our pharmacy. Dispensed prescriptions cannot be exchanged or credited. We will fully refund an auto-refill you didn’t want, as described in section 6, and we will correct any mistake we make. You can return a non-prescription item within 7 days of purchase for a full refund to your original form of payment, as long as it is unopened and in its original package. You’ll need your receipt or other proof of purchase.
10. Text messages
- Program. Regency Medical Pharmacy patient texts, sent from (805) 375-4050 through our texting provider.
- What we send. Replies to your messages, order and refill updates, delivery notices, refill reminders, and payment links if you choose to pay that way. We send offers, such as on non-prescription products, only if you separately agree to receive them. Agreeing to receive offers is not a condition of any purchase.
- How often. Message frequency varies with your orders and messages. Message and data rates may apply.
- Stop or get help. Reply STOP to cancel. We also honor END, CANCEL, QUIT, UNSUBSCRIBE, REVOKE and OPT OUT, or any other reply that reasonably asks us to stop. Reply HELP, or call (805) 375-4050, for help. If you stop texts, we will reach you about your prescriptions by phone or email instead.
- Your number. We do not share, sell or provide your mobile phone number or text-messaging opt-in consent to third parties or affiliates for marketing or promotional purposes.
- Security. Regular text messages are not encrypted, and anyone with access to your phone may see them. If you would rather we not text health details, tell us and we will use another method.
- Mobile carriers are not liable for delayed or undelivered messages.
11. Using our website
You may use our website for your own lawful, personal use. Please don’t:
- give false information, or someone else’s information without their permission;
- try to reach parts of the site, our systems or other people’s information that you are not authorized to access;
- use bots, scrapers or other automated tools to access the site or submit forms;
- interfere with the site’s security or operation; or
- use the site to break the law.
We may change, suspend or stop any part of the website at any time.
12. Privacy
Our Notice of Privacy Practices and our Consumer Health Data Privacy Policy explain how we handle your health information.
13. Content and trademarks
Regency Medical Pharmacy, our logo and the content of this website belong to us or our licensors. You may view and print pages for your personal use. Please don’t copy or use them in any other way without our written permission.
14. Other websites
Our website may link to websites run by others. We are not responsible for their content or practices, and their own terms and privacy policies apply.
15. Accessibility
We want everyone to be able to use our website. If you have trouble using any part of it, or need information in another format, call or text (805) 375-4050.
16. Website disclaimer
We work to keep our website accurate and available, but we provide it “as is.” We don’t promise it will always be available, free of errors or up to date, and we may correct errors at any time. This section applies to the website itself, not to the pharmacy care we provide. Nothing in these Terms limits our professional responsibilities as a pharmacy, or any right you have that the law does not allow to be waived.
17. Limits on liability for website use
To the extent the law allows, we are not liable for indirect or consequential damages caused by the website being unavailable or by errors in general website content. This limit does not apply to our pharmacy services, to personal injury caused by our negligence, to fraud or willful misconduct, or to any liability that California law does not allow us to limit.
18. Disputes
- Talk to us first. If you have a concern, contact us. We will try to resolve it within 30 days.
- Governing law. California law governs these Terms, without regard to its conflict-of-law rules.
- Where. Disputes may be brought in the state courts in Ventura County, California, in the federal court for the Central District of California, or in small claims court if you qualify. This does not limit any right the law gives you to bring a claim somewhere else.
19. Changes to these Terms
We may update these Terms. We will post the new version here with a new effective date, and the changes apply from that date. If a change affects the auto-refill program in a way that requires notice to you, we will tell you directly.
20. General
If any part of these Terms can’t be enforced, the rest still applies. If we don’t enforce a provision, we have not waived it. These Terms work together with other terms you accept with us, such as the auto-refill program terms. If they conflict, the more specific terms control.
